Case #1
A 48-year-old woman was having a simple gall bladder operation at the Park City Hospital when the new oxygen machine stopped working and her lungs were literally blown out. A simple 5¢ plastic disc that sat at the end of an oxygen machine could have prevented this tragedy. The disc was supposed to open to relieve excessive pressure on the patient's respiratory system. The valve was made in such a way that the little piece of plastic could fall into the main works and cut off the air exhaust. Tremont & Sheldon was able to find three similar occurrences under the same circumstances with the same type of machine in New Mexico, Maryland and New Jersey. We hired world-famous experts and were able to establish that the machine itself was dangerously designed, and that British Oxygen, the manufacturer, knew of the problem but hid it from the medical community. As a result of that case, in addition to recovering $6 million for the plaintiff, British Oxygen changed its design to a safer machine.
Case #2
A male in his 20s was killed when his truck jumped out of park and unexpectedly went into reverse. We took on the Ford Motor Company who's 1991 Ford Pickup was manufactured with the same "false park" design that had caused so many deaths in the 1970's. Through engineering experts, we showed that although the driver placed the shift in park, any vibration of the truck could cause the lever to jump into reverse, making the truck back up. We were able to obtain a judgment for the family of the young man who was killed in this tragedy and alert consumers nationwide of the fact that this dangerous design still exists and affects the motoring public.
Case #3
A 12-year-old girl was paralyzed in a swimming pool accident while at a birthday party. The pool, which was manufactured by Weatherking Products, Inc., was not affixed with depth markers, warning labels, or other adequate signs informing individuals, especially children, not to dive into certain parts of the pool. Through the discovery process, Tremont & Sheldon obtained information that for years the pool industry has been aware of these tragic accidents yet has not put up warning signs, decals, and markers because they would have an adverse effect on swimming pool sales. Tremont & Sheldon has collected in excess of $1.5 million dollars for the injured girl.
